New delhi: Recently ministry of electronics and information technology minister Ravi shankar prasaad has introduced new guidelines I.e(guidelines for Intermediate and digital media ethics code rule 2021) in a press conference. 

What is it :-

These are the set of rules which will prohibit the unlawful, hateful, immoral and unethical content in all social media and ott (over the top) platform. 

Where it will applicable?? 


It will be applied on all social media  ( WhatsApp, Facebook, Instagram) and ott platform ( over the top) I.e Netflix, Amazon Prime etc.

features of it :-

1:-  Will take down unlawful content in specific time


2:-  There will be separate category for sexual content and have to remove content within 24 hours


3:-Will track first originator-- like in case of fake news it will help to find the first creator. 


4:- Appointment of 3 India resident employees--  


First - chief compliance officer --  who will ensuring compliance

Second-    nodal officer ------- who will be in coordination 24×7

Third -   Grievance officer -------   who will be responsible for all functioning


5:-  3 tire structure:-   first there will be an grievance residential officer where all the complaint will file and if he doesn't find any unlawful content in it ( Netflix etc. ) then a person can move to a self regulating bodies and further if they also denied that there is no unlawful content than he may move to inter department government committee which is established by the I&B ministry. Same as our judiciary system first district court then high court and after that supreme Court. 


Conclusion

Some head of this new rules are good which talk about sovereignty and integrity of India. but somehow it may violate the right to privacy under (art.21) .

for example when  we chat in WhatsApp there is an end- to -end encryption which means only you and your partner knows what you talk about but when the new rule will come it may stop the end- to-end encryption by which government will have access to your chat to find the first originator. 

Government has introduced these new rules because few weeks ago there was a clash between Twitter and government. Where Government told Twitter to ban 1000 Twitter account but Twitter only ban 200 account .
